Welcome to our Garden Maintenance Services in Edmonton. By engaging our services, you agree to the following Terms and Conditions. Please read them carefully.

1. Definitions

  • Service Provider: Refers to our company offering garden maintenance services.
  • Client: The individual or entity hiring our services.
  • Agreement: The contract outlining the terms between the Service Provider and the Client.

2. Scope of Services

We offer comprehensive garden maintenance services including but not limited to:

  • Regular lawn mowing and trimming
  • Pruning of shrubs and trees
  • Weed control and removal
  • Planting and fertilization
  • Seasonal cleanup

Specific services will be detailed in the Service Agreement provided upon booking.

3. Client Responsibilities

The Client agrees to:

  • Provide accurate information about the garden area and any specific requirements.
  • Ensure access to the garden during scheduled service times.
  • Inform the Service Provider of any existing issues or hazards.
  • Timely payment as per the agreed schedule.

4. Payment Terms

Payment for services is due as outlined below:

  • Deposit: A non-refundable deposit of 20% is required upon booking.
  • Invoices: Invoices will be issued bi-weekly/monthly and are payable within 14 days.
  • Late Payments: A late fee of 5% will be applied to overdue invoices.

All payments should be made via the accepted payment methods specified in the Service Agreement.

5. Liability

Service Provider is committed to maintaining the highest standards. However, we are not liable for:

  • Damages caused by unforeseen natural events such as storms, floods, or frost.
  • Pre-existing conditions not reported by the Client prior to service commencement.
  • Accidents or injuries occurring on the Client's property unless caused by our negligence.

Clients are encouraged to inform us of any areas of concern to mitigate potential risks.

6. Cancellation Policy

Clients may cancel or reschedule services by providing at least 48 hours' notice. Cancellations made within 48 hours may incur a cancellation fee equivalent to 50% of the scheduled service cost.

In the event of repeated cancellations, the Service Provider reserves the right to terminate the Agreement.

7. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Clients will be notified of any significant changes via email or through our website. Continued use of our services constitutes acceptance of the updated terms.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in Edmonton.

9. Confidentiality

All personal and property information provided by the Client will be kept confidential and will not be shared with third parties without the Client's consent, except as required by law.

10. Termination

Either party may terminate the Agreement with a written notice of 30 days. Upon termination, any outstanding payments for services rendered up to the termination date must be settled within 14 days.

11. Force Majeure

The Service Provider shall not be held liable for any failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, acts of government, or other unforeseen circumstances.

12. Entire Agreement

This Agreement constitutes the entire understanding between the Client and the Service Provider and supersedes all prior discussions, agreements, or understandings of any kind.

13. Amendments

Any amendments or additions to this Agreement must be made in writing and signed by both parties.

14. Severability

If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

15. Indemnification

The Client agrees to indemnify and hold harmless the Service Provider from any claims, damages, or expenses arising out of the Client's use of the services provided.

16. Notices

All notices under this Agreement shall be in writing and delivered to the addresses specified in the Service Agreement or as otherwise agreed upon by both parties.

17. Acceptance

By engaging our Garden Maintenance Services, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
